Marc Greenwald is a trial lawyer, founding member of Quinn Emanuel's New York office and the partner in charge of the New York Pro Bono Practice. Mr. Greenwald has tried cases in both federal and state courts, and has handled cases in many jurisdictions throughout the country. Mr. Greenwald has also arbitrated cases in front of AAA, JAMS, the ICC, and FINRA. Mr. Greenwald has also argued significant appeals in the Second Circuit, Fourth Circuit and New York’s Appellate Division. Mr. Greenwald has been recognized by Legal 500, Lawdragon 500, and SuperLawyers and has received awards from the Department of Justice and the American Antitrust Institute.

Mr. Greenwald formerly served as a Co-Chair of the firm’s Government Enforcement practice. Mr. Greenwald appointed by the judges of the Southern District of New York to serve on that court’s Criminal Justice Act Panel.

Mr. Greenwald’s clients include investment funds, tech companies, large corporations, start-ups and individuals. He has handled significant cases in many areas of practice, including software licensing, copyright, trademark, trade secret, antitrust, bankruptcy, financial fraud, contractual disputes and employee movement. In 2018, Mr. Greenwald was awarded Outstanding Antitrust Litigation Achievement by the American Antitrust Institute.

Prior to joining Quinn Emanuel, Mr. Greenwald was an Assistant United States Attorney in the Southern District of New York, where he conducted a dozen jury trials and argued seven appeals in the Second Circuit. Mr. Greenwald earned the Department of Justice Director’s Award for Superior Performance as an AUSA. Before serving as a federal prosecutor, Mr. Greenwald was a policy advisor at the U.S. Treasury Department and a law clerk to Ninth Circuit Judge David R. Thompson. Mr. Greenwald, who has a Masters Degree in History, also worked as a high school teacher at a New York City public school.

  • Represented biotech-focused fund in a dispute with one of two co-founders.
  • Represent large fund in dispute over aircraft-engine leases
  • Represent oil and gas focused fund in a series of disputes related to trust royalties.
  • Represented real estate fund in activist battle with commercial REIT.
  • Represented hedge fund in a short-seller securities dispute.
  • Represented liquidators of a large hedge fund in litigation over swaps contracts.

Intellectual Property Litigation

  • Represent large enterprise software company in multiple licensing disputes.
  • Represent major AI company in trademark litigation.
  • Represented Virgin Group in trade secret matter regarding Virgin Cruises.
  • Represented Google and Twitter in Second Circuit in matter involving application of the “hot news misappropriation” doctrine.
  • Represented Mattel against copyright and related claims against its UNO product line.

Government Enforcement

  • Represented CEO of Luxembourg investment firm in investigation by the U.S. Department of Justice and U.K. Financial Conduct Authority.
  • Represented labor union in federal investigation of political fundraising.
  • Represented Switzerland-based Chartwell Asset Management in SEC Insider Trading case. In February 2012, after pursuing months of discovery, the SEC dismissed its claims against Chartwell.
  • Represented Italian caviar importer Isidoro Garbarino in notable Customs prosecution in SDNY. Obtained sentence of time served for Mr. Garbarino even though he had been a fugitive for more than 20 years.
  • Represented European investor in SEC investigation of alleged market manipulation in U.S. listed securities. The SEC took no action against our client.

Antitrust and Class Action Litigation

  • Served as one of the principal lawyers for the class in the ISDAfix Antitrust Litigation
  • Represented E*TRADE in a contract class action related to indicative rates for borrowed securities in short sales.
  • Represent large corporations in antitrust claims against Visa and MasterCard.

Commercial, Securities and Financial Litigation

  • Represented European Satellite Manufacturer in dispute with a satellite and defense financing company.
  • Represented Amplifi Live related to financing for Woodstock 50 music festival.
  • Represented trustee of Parmalat S.p.A. in lawsuits arising out of the largest bankruptcy in European history against various financial institutions and accounting firms.

  • Represented large group of tech investment bankers who left UBS for a boutique firm.
  • Represented large group of investment advisors who left Smith Barney for a boutique firm.
