  • Represented Samsung in a number of trials involving trade dress, design patent, and utility patent disputes with Apple in the Northern District of California, the Federal Circuit, and the International Trade Commission.
  • Represented Mattel in two highly publicized trials against MGA involving Bratz dolls.
  • Represented Nike, after adidas prevailed on claims in Europe that Nike's use of two stripes on apparel infringed adidas's three-stripe trademark, by filing complaint in the District Court of Oregon seeking a declaration that Nike's use of two stripes and other decorative striping on apparel and footwear in the United States did not infringe or dilute adidas's three-stripe mark. After positioning the case to put the scope of adidas's three-stripe mark at issue, adidas conceded the case and filed a broad covenant not to sue Nike in the United States over apparel and footwear products that incorporate a wide variety of multi-stripe designs, including all Nike two-stripe products.
  • Successfully defended Nike against a $40 million trade dress and design patent infringement claims by a rival shoe company over Nike's Air Jordan XVII basketball shoe.
  • Obtained multi-million dollar verdict, injunction, and award of attorneys' fees in a trade dress infringement action for Mattel.
  • Obtained seven figure settlement for a well known consumer products company in a misappropriation of trade secret case.
  • Represented TCW in highly publicized dispute with former Chief Investment Officer.
  • Obtained a defense verdict for TRW following a four week trial in which plaintiff, a twenty-six year employee and director of finance of our client, claimed that he was terminated because he spoke out about mischarging on government contracts. Plaintiff had sought over $10 million in compensatory damages, and was also seeking punitive damages. A related qui tam suit filed by plaintiff, and defended by another law firm, resulted in a settlement in excess of $100 million.
  • Obtained defense verdict in a three-week jury trial in which plaintiff alleged that he was terminated and denied millions of dollars in commissions for refusing to engage in illegal activity.
  • Obtained favorable settlements for King’s Hawaiian in a series of infringement actions involving King’s Hawaiian packaging trade dress
