Elisabeth Miller is Of Counsel in Quinn Emanuel’s New York office. She joined the firm in 2012. Elisabeth has represented clients in both federal and state courts, and before arbitral bodies, for a broad range of claims, including antitrust, breach of contract, civil RICO, computer fraud, public nuisance, securities, and trade secret and intellectual property misappropriation.
While she regularly appears in courts across the United States in her general commercial litigation practice, a focus of Elisabeth’s is defending multi-district litigation lawsuits pertaining to prescription opioids. She also has particular interest and extensive experience in the Delaware Court of Chancery and is well versed for her corporate clients on the nuances of practice in this critical venue. Admitted to practice law in New York and Pennsylvania, Elisabeth advises clients on legal issues in both jurisdictions.
Elisabeth also has expertise in employment matters, representing both employers and employees in pre-litigation investigations and mediations, and litigation before courts and arbitral bodies. For employers, she has acted to enforce former employees’ restrictive covenants and in defense of wrongful discrimination, harassment, and other claims brought by former employees. For employees, Elisabeth has defended clients in pre-litigation internal and governmental investigations and has likewise brought claims on their behalf against former employers.
Elisabeth has worked on cases at all stages, from inception to trial, and has been a key member of numerous winning trial teams, for which she has successfully argued dispositive motions and taken key witnesses. She also maintains an active pro bono practice, with recent representations including a criminal matter in the Southern District of New York, for which Elisabeth secured a sentence of time served for her client, as well as a complete victory against the NYC Department of Education on behalf of a student with special needs who was denied a free appropriate public education. During law school, Elisabeth was a law clerk at the United States Attorney’s Office for the Eastern District of Pennsylvania.
