Robert Stone is a partner in Quinn Emanuel’s Silicon Valley office where he has been resident for more than 25 years. Robert’s practice focuses on intellectual property litigation with a particular emphasis on patent litigation. Since joining Quinn Emanuel from Shearman & Sterling in 1997, Robert has represented clients in a wide array of intellectual property matters in fields such as computer hardware and software, semiconductor, biotechnology, medical devices, and automotive.

In the intellectual property arena, Robert has litigated and first-chaired trials and arbitrations for clients such as Voxer, IBM, ASM International, Cisco, MotionPoint, Box, Meru Networks, Informatica, Borland, Genentech, Abbott, Roche Molecular Systems, Third Wave Technologies, Avery Dennison, and Delphi Automotive.

  • Lead counsel for Voxer, Inc. against Meta Platforms (Facebook and Instagram) in a two patent jury trial in the Western District of Texas. Jury verdict of $174.5 million. Final judgment entered for more than $200 million in February 2023.
  • Lead counsel for ASM IP in ICDR/AAA arbitration involving breach of a patent license agreement with Kokusai Electric resulting in $61 million settlement for ASM. Resolution of disputes with Kokusai Electric netted ASM a cumulative $176 million recovery in 2019.
  • Lead counsel for IBM in patent infringement action involving VoIP technology in W.D. Texas.
  • Lead counsel for IBM in patent infringement action involving chip cooling technology.
  • Lead counsel for ASM International in cross-border patent enforcement proceedings against Kokusai Electric resulting in $115 million settlement and patent license for ASM.
  • Lead counsel for Total Recall Technologies in breach of contract and fraud action against Palmer Luckey and Oculus.
  • Lead counsel for IBM (Truven) in patent infringement/trade secret action brought by Cave Consulting Group. Case dismissed at summary judgment on Section 101 grounds, and plaintiff voluntarily dismissed pending Federal Circuit appeal.
  • Lead counsel for IBM in patent infringement action brought by Twin Peaks Software. Patent invalidated at summary judgment on indefiniteness grounds and decision affirmed by Federal Circuit.
  • Lead counsel for MotionPoint in competitor jury trial in Northern District of California against TransPerfect. Matter resolved favorably with Federal Circuit appeal pending.
  • Represented IBM at trial of patent matter in E.D. Texas relating to blade server technology.  Matter resolved favorably following settlement.
  • Represented IBM in a patent infringement matter in which the plaintiff alleged that IBM's UDDI offering infringed a patent related to trade network software.  Obtained summary judgment of non-infringement and invalidity which was subsequently affirmed by the Federal Circuit.
  • Successfully represented IBM in patent litigation with ASUSTeK Computer, Inc. involving offensive and defensive patent claims in S.D. Cal.  Matter resolved favorably following settlement.
  • Successfully represented Roche against Stanford University in case involving HIV diagnostic test kits. Board of Trustees of Leland Stanford Junior University v. Roche Molecular Systems, Inc., 563 F.Supp.2d 1016 (N.D. Cal. 2008).  Ownership awarded to Roche in leading case involving such rights. 583 F.3d 832 (Fed. Cir. 2009), aff’d, 131 S. Ct. 2188 (2011).
  • Represented Genentech in connection with Columbia University's assertion of the Axel Patents in multi-district litigation in D. Massachusetts.  Obtained broad covenant not to sue on behalf of Genentech in connection with the dismissal of that action.
  • Represented Third Wave Technologies in litigation in W.D. Wisconsin against Innogenetics relating to Innogenetics' patents related to Hepatitis C.  Obtained a favorable resolution by way of settlement.
  • Represented Avery Dennison in connection with a patent malpractice lawsuit brought in W.D. Texas by the alleged inventor of personalized postage.  Obtained dismissal for lack of standing and wide-ranging discovery sanctions.
  • Represented IBM in connection with patent litigation brought by the Wisconsin Alumni Research Foundation in W.D. Wisc. relating to semiconductor technology.  Obtained a favorable settlement with summary judgment motions pending.
  • Successfully represented numerous clients in connection with disputes brought by notorious patent trolls such as Acacia, Constellation I.P. and its related entities, Technology Properties, LTD., and the Ronald A. Katz Technology Licensing L.P. Patent Portfolio.
  • Represented Informatica in connection with trade secret litigation related to the hiring by its competitor Ascential of key sales employees.  Obtained a consent judgment and permanent injunction against Ascential and the former Informatica employees.
